Welcome to D&M Luxury Rentals, LLC
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into between (the Guest) and (D&M Luxury Rentals, LLC) as of the Reservation Date of the property identified on the DMluxuryrental.com website. Occupying this property confirms that the guest agrees to and is legally bound by all the terms of this agreement. This agreement is entered into freely, without coercion by (the “Guest”). The guest is defined as the person charged for the rental of the property. The Guest has agreed to rent the property described in the title above (the “Property”), for the duration of the Rental Terms for the Total Rental Fee, including taxes, cleaning fee and other fees identified in the transaction on the DMluxuryrental.com website, and other good and valuable consideration as described herein.
OCCUPANCY: The guest agrees that no more than [Max number of Guests] persons shall stay overnight at the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon the guest under this Agreement. The guest shall be financially responsible for any damage or theft caused by their guest, or anyone authorized on the property by the guest. The guest shall immediately notify D&M Luxury Rentals, LLC of anyone visiting the property without their authorization. Failure to report unauthorized personnel visiting the property shall be considered authorization of the guest and the guest shall be held financially responsible for any damage or theft caused by the visitor. The guests are not responsible for personnel authorized by D&M Luxury Rental, LLC to visit the property i.e., maintenance / repair personnel or cleaning personnel.
CONDITION AND USE OF PROPERTY: The Property is provided in “as is” condition. D&M Luxury Rentals, LLC shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. D&M Luxury Rentals, LLC shall not be held responsible for such items' failure to work but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
GUEST LIABILITY FOR DAMAGES: Guest shall be held financially liable for any damages or theft cause to the property by the guest or the guest authorized visitors. The guest authorizes D&M Luxury Rentals, LLC to charge the cost of any and all damages to the property caused by the guest or the guest’s authorized visitors or that occured during the time the guest occupied the property, to the Credit Card on file with D&M Luxury Rentals, LLC / Stripe, that was used to rent the property. The guest and D&M Luxury Rentals, LLC agree that a quote for the damages will be provided to the guest and to D&M Luxury Rentals, LLC within 60 days of the date the guest checks out of the property. In the event that Stripe cannot or will not charge the cost of the repairs to the Credit Card on record. The guest agrees to authhorize Stripe or any other collecting agency to provide the credit card information to D&M Luxury Rentals, LLC, so that D&M Luxury Rentals, LLC can charge the cost of the damages to the credit Card. If the charges cannot be run on the Credit Card provided the guest shall, provide another form of payment to cover the damages.
DEFAULT: If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
ASSIGNMENT OR SUBLEASE: Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
RISK OF LOSS AND INDEMNIFICATION: Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest, or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and D&M Luxury Rental, LLC shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless D&M Luxury Rentals, LLC and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold D&M Luxury Rentals, LLC harmless in all such cases.
RELEASE: Guest hereby waives and releases any claims against D&M Luxury Rentals, LLC, the Property owner and their successors, assigns, employees, or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities, or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk, and responsibility.
ENTRY AND INSPECTION: D&M Luxury Rentals, LLC reserves the right to enter the Property at anytime if any of the terms of this agreement has been deemed to be breeched. D&M Luxury Rentals, will notify the guest of the breech of the terms of this agreement and give the guest time to correct the breech. If in the oppinion of D&M Luxury Rentals, LLC the breeche has not been corrected D&M Luxury Rentals, LLC shall inspect the property to esure the breech has been corrected. If D&M Luxury Rentals, LLC has a reasonable belief that there is imminent danger to any person or property, D&M Luxury Rentals, LLC may enter the Property without advance notice.
UNAVAILABILITY OF PROPERTY: In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of D&M Luxury Rentals, LLC, they will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupan cy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, D&M Luxury Rentals, LLC shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated, and Guest and D&M Luxury Rentals, LLC shall have no further obligations or liabilities in any manner pertaining to this Agreement.
PROPERTY RULES / EVICTION:
• To rent this property guest are required to be a minimum age of 25 years old. All guest do not have to be 25 years old only the guest being charged for the rental.
• Pets are not allowed at this properties
• Parties and events are not authorized at this property
• This is a no smoking property, smoking is authorized outside of the property.
• Quite hours are from 10:00 PM – 8:00 AM daily. During quite hours the guest will not make any noise that can be heard outside of the property nor shall they gather on the outsid and make noise that disturbs the neighbors.Breaking any of these rules or violating any of the terms of this agreement are ground for eveiction without a refund.
